Have You Been Arrested Or Released From Jail Recently?

By Sonia Munoz Recent changes in Immigration policies make mandatory detention much more likely for Visa holders and Lawful Permanent Residents. If you have been recently arrested or have been released from prison after October 8, 1998, you may be a candidate for mandatory detention. Immigration and Customs Enforcement (ICE) may arrest and hold you in an Immigration Detention Facility based on the criminal charge. This may happen even if you served a minimal amount of time in jail. The key element is that the criminal charge, arrest, or release from custody have occurred after October 8, 1998. On March 21, 2007, in Matter of KOTLIAR-, 24 I&N Dec. 124 (BIA 2007), the Board of Immigration Appeals ruled on the topic of mandatory detention during a bond re-determination hearing. The Board of Immigration Appeals (BIA) is the governmental body having jurisdiction over appeals submitted by detainees and respondents who have been ordered deported by an Immigration Judge during removal proceedings. According to the BIA, its ruling is consistent with the concern from Congress that criminal aliens will continue to commit crimes and not appear at the removal hearings. It is important to note that the alien is able to request release and bond in front of an Immigration Judge where the grounds for detention are not included in the charging document from the Department of Homeland Security. Based on the BIAs recent ruling, an alien who has been apprehended from home while on probation for a criminal conviction is subject to mandatory detention. The individual is to be mandatorily detained by ICE regardless of the reason for the criminal custody or arrest. He or she can be subject to mandatory detention as long as the arrest or the release occurred after October 8, 1998. This recent ruling came about as a result of an appeal from an individual who entered the United States as a visitor and stayed for longer than authorized, who had been convicted of several crimes. According to the BIAs ruling, individuals having served time in jail or on probation are subject to mandatory detention. Even an individual who has been arrested before a conviction is given may be subject to mandatory detention for immigration purposes. It is important to note that even if the arrest was based on a crime that is not the grounds for your charges of deportation, you may still be subject to mandatory detention. An individual can appeal a final order of deportation by the Immigration Judge to the BIA. In some cases, the individual can even appeal to the Circuit Court having jurisdiction over the case. In general, the BIA is the last governmental body to review the individuals case. Hence, the decision by the BIA is the final say on whether the individual appealing is able to stay in the United States or is to be deported. By Kelley Robertson In a recent marketing workshop I attended, I discovered that most business owners rely on just two or three strategies to attract new business. Even well-established companies tend to rely on one or two strategies. However, there is a multitude of ways to drive new business to your door. Here are a few: Networking. Perhaps the most commonly used approach by small business owners. However, it is often poorly executed. Many people attend a networking function and take the wrong approach by trying to meet as many people as they can. They bounce from person to person, handing out business cards like it is an Olympic event and they are vying for the gold medal. They fail to realize that the most effective way to network is to cultivate relationships and give referrals to other members first. Referrals. This marketing strategy places a close second in preferred methods of generating new business leads. The key here is to develop a systematic approach to ensure that you take proactive approach instead than a passive one. Rather than assuming that satisfied client will refer someone to you, ask for that referral. Tell people who your ideal client is and ask for their help in finding these types of clients. The real estate agent who represented the seller when we bought our house, sends us a card every year and reminds us that she loves referrals. It is not pushy, does not sound like shes begging, and Im confident it helps generate new leads. Writing. This often under-utilized strategy is an excellent way to become recognized as an industry expert. Every industry has trade magazines and most are hungry for good content. The Internet is also filled with websites and e-zines looking for material to send to their subscribers and customers. I now write at least one article every month and send it to more than two hundred publications. This strategy alone has helped drive more traffic to my website more than anything else. It is sometimes challenging to come up with ideas and to write an 800 word article but the investment of time and effort is definitely worth it. Newsletters. This is another powerful technique to keep your name in front of your customers and prospects. Provide key insight into business challenges and offer solutions to them. In other words, help your prospects and customers solve problems. Some newsletters are nothing more than advertising so be sure to provide valuable information to your customer. Although it is less expensive to send a newsletter electronically you can issue it in paper format. A local real estate agent regularly sends out a one-page update of the housing market in our neighborhood. Cold calling. Without a doubt, this is usually the most challenging way to market a business - I know very few people who actually enjoy cold calling. However, it can be a good way to uncover qualified prospects in a relatively short period of time. Be sure to start your conversation with a good opening to capture the other persons attention. Give free information. At the marketing workshop I attended, the facilitator suggested to give information to interested prospects. I have used this approach on my website and have quadrupled the number of subscribers to my newsletter in the last year. You do not need to give away ALL the information relevant to your product or service. Instead, offer information that will help your target market with their problems. For example, when people sign up to my e-zine, they receive a report that outlines 100 tips they can use to increase their sales. Offer a guarantee. A concern many people have when changing suppliers is the risk associated with the change. They may not be completely satisfied with their existing supplier but the risk of choosing a supplier who may be worse can prevent them from changing. Eliminate this concern and offer a guarantee. Advertising. This can be a great strategy if you know how to create a good ad. The best marketers know that great sales copy is what makes the difference; I have experienced this first-hand. When I began selling my book on my website, I generated mediocre results for the first two years. I eventually changed the copy on my site and sales have soared every since. Glance through the ads in your trade magazine and you will quickly notice that most ads focus on the companys product features instead of on the customers problem. Create a great ad by concentrating on the problem you can solve. There are many other ways to market your business and generate new business leads. However, the ideas I mentioned in this article are effective low- or no-cost options. The Slimming World Of A Weight Watcher

By Karen Hall-Foster For all of those people who feel that they have let themselves go, I sincerely sympathise. Its no laughing matter when you step onto the dreaded scales, after months if not years of avoidance, only to see the needle point heavily in the wrong direction! Denial is more than likely the root of the problem, denial of the fact that there is an actual problem at all, can be one of the hardest things to face. Once you have acknowledged that you have unknowingly slipped out of the normal category into the morbidly obese section - missing the in-between stages of: slightly overweight overweight (which shouts out for you to stop and look what your doing to yourself) getting very fat - fatter still until there are two of you for the price of one! Then and only then, can you start to do something about your predicament. If you have ever seen a comic strip where a diet club is represented by a mentor who is stick thin and unforgiving towards the weakness of its members, then you will appreciate the struggle that is inherent from joining such a place for help and support. This portrayal never ceases to amaze me with just how accurate an assessment they have made of such events. Needless to say I have been to them heavily swinging between Slimming World and Weight Watchers over the past twelve years. Every time I go I bow my head down low in shame (because to-date I have never quite managed to reach my target goal) and pray to God that Im not recognised I always am. This is not through a want of trying either temptation always rears its ugly head. I remember the last time I went to a weight management session a few years ago and how I pleaded for extra guidance out of desperation, to which she curtly replied in a tut tut kind of fashion that I just had a bad attitude. Mortified, I knew from then on that all these diet clubs were only out to make money from poor helpless suffering individuals such as myself, who just wanted a bit of sincerity and support. Habit. This is what I would describe as my biggest battle. Habit means that we dont have to think about what we are eating or what it really is doing to our bodies. Complacency follows very close behind and then of course laziness as we reach for the Take-Away menu more than once in a week. This vicious circle eventually always leads towards developing an addictive behaviour which in turn, boosts the cravings that stubbornly refuse to go away. Even when you are told that cravings only last for so many minutes what they dont tell you is that they come back relentlessly again and again and relatively quickly, until they have been unduly satisfied. I recently went to the doctor for help, and yes she was a lovely slim woman who I immediately envied. I told her of my plight and frustrations tears and emotions poured out from seemingly nowhere, I hadnt realised how depressed I was. She referred me to an NHS diet clinic. So I went to see the nurse, yes also slim however, what amazed and shocked me was her lack of knowledge regarding food and nutrition and that there was no healthy plan-of-action available, she was just there to promote the 5 A-DAY portions of fruit and vegetables, with the option of weighing me weekly. Other than that, yes youve guessed its all down to me and my determination to shift those unsightly pounds by myself. Back to square one then. So, I really take my hat of to all those people who not only lose weight but loose a lot of weight and keep it off. I buy the magazines and I read the stories and I envision myself in their shoes. I have lost weight before and no doubt I can lose it again, its a motivational thing at the end of the day and one you have to be in the right frame of mind for. I currently have to shift 80-90lbs and my goal is not driven by vanity where to be able to look good takes priority but one for which, is motivated by health aspects more than anything. I really want to live a healthier lifestyle, to have more energy and more enthusiasm towards my life. The other day I felt reclusive and that is not me and this was my turning point, not a holiday snap of a beached whale on the sand in Spain, but the fact that I was slowly burying myself so that I didnt exist anymore. My home was my tent not my kaftan! From my research and life experience its not about fad diet clubs, diets or strict regimes that result in eating what you hate. Its about finding that healthy balance once again, moderate portion sizes and proper meal times oh and 5 a-day fruit & veg! I am the only one who can do this and its now time for me to accept the responsibility for my life, before Im attacked by illness and the choice is taken away from me. Getting into shape takes patience, endurance, ongoing support from loved ones and the knowledge that finding your self-esteem is worth far more than a quick-fix of sugar, saturated fat or fast-food covered in monosodium-glutamate. And if in the meantime you pass anyone who is severely overweight, try not to judge them too harshly because one day it really could be you. My name is Karen … and I have a weight problem. Is it conceivable that every major and/or minor mistake, embarrassment, error or screw up has what amounts to be the perfect fix, crafted specifically for that situation and aggrieved recipient? Apparently of the thousands of different ways to say I’m sorry some techniques are much better and more likely to succeed than others. Yet, despite the importance of apologies in our daily lives there is almost no research on the subject. The work that has been done usually points to the following list of ingredients - a description of the error; acknowledgment of the offense; acceptance of responsibility; a willingness to own the mistake; an explanation; regret, humility and remorse; a request to be forgiven; a credible effort to prevent the error from happening again; and some form of compensation. But the probability of success or failure is not simply a function of following these ‘perfect apology’ guidelines. Now, some of these apologies worked while others failed. Mel Gibson seems to have mended a sufficient number of fences with the Jewish community by following the same strategy. Mel’s apology was so successful he admits to being “overwhelmed by the understanding.” But other mistakes and apologies were less successful. Michael Richard’s career is not likely to survive despite repeated efforts to apologize by attaching himself to prominent members of the African American community, arranging press conferences with Jessie Jackson and Al Sharpton, and promising to spend the rest of his life fixing the mistake. Apparently, perfect apologies really work best when delivered to recipients who are prepared to forgive. The content of the apology itself is often not the point, especially when the aggrieved community sees an opportunity to push the hurt a little further. Most public apologies almost never completely succeed, for a very simple reason- you can’t please all of the people all of the time, no matter how meticulously and sincerely you follow the ingredients of a perfect apology. The underlying point is that public (especially public ‘political’ apologies) almost never satisfy a sufficient number of people to be considered truly successful (because the apologies are accepted or rejected for political reasons and have almost nothing to do with the apology itself, or whether the ingredients were followed). On the other hand, personal apologies are almost always successful if and when the guidelines are followed, because you’re dealing essentially with one person.
